Carroll County Decision Reversed on Appeal

In this case, the Carroll County Court of Common Pleas issued a default judgment against the mother and awarded damages to the other parties. Believing the decision to be incorrect, attorney Thomas Erb argued that the default judgment and the resulting orders were invalid. The Court of Appeals sided with Erb and the mother's argument, reversing the previous decision.

Custody Decision Upheld on Appeal in Medina County

Attorney Thomas Erb successfully represented a mother in a custody appeal that spanned Ohio and Louisiana and involved severe abuse allegations. The appeal was filed in the Court of Appeals of Ohio, Ninth District, Medina County. It centered around a Medina County Court of Common Pleas, Domestic Relations decision to vacate a temporary custody order to the child’s father until Louisiana could address concerns regarding potential abuse. However, it was learned that the Louisiana court and the parties involved had taken steps to rectify the situation. Not agreeing with the court’s assessment, the father appealed. Erb Legal handled the appeal on behalf of the mother, and ultimately the court saw no error and affirmed its decision to vacate the order.

Felony Dismissed via Video in Summit County

Not long ago, Erb Law attorney Wesley Buchanan appeared on his client’s behalf through video in the Summit County Court of Common Pleas. Charged with a fifth-degree felony for failure to register 2950.04(E)/ 2950.99, it was determined that video sufficiently guaranteed the integrity of the proceedings and protected the interests and rights of all parties. The case concluded with a complete dismissal of the felony charges with prejudice, and attorney Buchanan effectively served his client without a physical court appearance.

Appeals Court Overturns Lower Court Decision in Favor of Erb Client

Erb Legal represented a mother in the Ohio Court of Appeals, Fifth Appellate District to overturn a common pleas court’s decision in a custody battle. Previously, the father filed for and was granted relief, which overturned the court’s decision to dismiss his parentage claim. He was awarded parenting rights after the mother and child returned to Florida. In the appeal fight, Erb Legal’s careful attention to detail and knowledge of Ashland County’s local court rules showed that the father’s argument to overturn the court’s decision was untimely and based on errors. The appeals court sided with the mother, overturning the trial court’s decision.

Appeals Court Affirms Client's Divorce Judgment

Erb Legal represented and supported a wife as her ex-husband filed an appeal to argue their divorce was unfair. However, the appeals court affirmed the decision in the wife's favor, as all three errors the ex-husband claimed were overruled.

Inter-State Custody Settled on Appeal

After helping a client overturn a child custody court ruling that stated a child’s home state should be Ohio, the other party elected to appeal. Erb Legal maintained that the Court of Appeals was correct and argued that custody should remain in Louisiana. Following our arguments, the Supreme Court declined to review the decision, and the child was ultimately returned to Louisiana.
